You may have realized by now if you were interested in buying a house, that in some residential neighborhoods (namely row houses, those with access to the property very close to the road) the cadastral document is not enough for the entire complex.
Practically, in these types of neighborhoods, cadastral subdivisions of the land are made. Thus, a housing unit of this type, a house, has the following:
– 1 land registry extract of the construction (the house itself);
– 1 land registry extract for each parking space;
– 1 land registry extract of the back garden;
You wonder why? Because the parking space, the garden, and the building are sold with different VAT rates (for certain types of credit), and the transfer of ownership to the notary is clearly done using different cadastral numbers.
Here, further, is a situation we faced last month:
The client came to us after purchasing the property: a house with a parking space and a green space with a lawn, fenced in, to which only he had access through the back exit, from the living room.
During the inspection, the client had the documents without a land registry extract for the garden and the parking space. Basically, he did not know that the contract he had concluded with the developer did not include the parking space and the garden.
Since the developer was not there during the inspection, I spoke with the client and explained the document situation and his legal options.
The client went to talk to the developer, who, in order not to give up on the signed contract, offered him a discount on the price of the garden.
From experience we know that there are many clients who are not very familiar with cadastral documents and rely only on what the developer tells them without being able to verify exactly. In this case, we helped the client understand the documents he received and explained what else he needed to be the legal owner of the land he bought.
So if you want to buy a house or apartment in the future, pay attention to the land registry and if you encounter any difficulties, we are just a phone call away.
When we get out, I notice a hole outside the fence. I approach and push the dirt aside with my hand. That's how I discovered the cylinder that had just been buried and to which the boiler was connected to make it look like it was connected to the gas network:
– Have you made any changes recently?
– No, why?
I tell him about the bottle I found. We gave up on continuing the assessment and left, informing the client about what had happened.”
Of course, the customer gave up on the purchase, but the best part is that we helped him, in the end, make an informed decision.
