General provisions
These Terms and Conditions apply to the website. www.myfairvalue.ro owned by FairValue.FairValue reserves the right to make changes to the content of this site, as well as to these Terms and Conditions, without any prior notice to Users. In case of divergence or disagreement between the Company and the User, the Terms and Conditions valid at the time of use will apply. www.myfairvalue.ro.
„Content"includes the following elements:
a. all information available on the Site www.myfairvalue.ro which can be visited, viewed or otherwise accessed by electronic means;
b. the content of any e-mail sent to Internet Users interacting with the Site by FairValue through electronic means and/or any other available means of communication; c. any information communicated to the User through any means by an employee of FairValue, according to the contact information specified by this User; d. data relating to FairValue or other privileged data of the Company.
„User" - the natural person who browses the Site or interacts, in various forms, with it and has access to the Content;
„Personal data" - any information concerning an identified or identifiable natural person ("the person concerned"). Represents personal data (non-exhaustive list): the person's name and surname, email address, telephone number, etc.;
„Personal data controller"- means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. With regard to the Site, the data controller is represented by FairValue;
„Consent of the data subject"- any free, specific, informed and unambiguous manifestation of the data subject's will by which he or she, by a statement or by an unequivocal action, signifies agreement to the processing of personal data concerning him or her;
„Processing"- any operation/set of operations performed on personal data (with or without the use of automated means), namely: collection, recording, organization, structuring, storage, adaptation, modification, extraction, consultation, use, disclosure, dissemination, making available, alignment, combination, restriction, erasure, destruction, etc.
The Document establishes the terms and conditions of use of the Site/Content by the User. The User is requested to carefully read this Document in order to prevent any unwanted/unpleasant consequences, which may be considered by the User as having a negative impact on his/her data and/or information provided to FairValue.
3.2. Site Content
The site contains information, presentations and articles regarding the range of valuation services offered by FairValue, as well as other related areas of interest. To request a quote, the User will access the "REQUEST A QUOTE" section available on the site, in the sections related to the valuation services offered by FairValue. Within the form, the User will have to complete the fields related to the name, telephone number and message, and will be contacted by a FairValue representative in a timely manner, respectively within 1-5 business days.
Through the Site, useful files for FairValue's Visual Identity and Marketing can be downloaded, available to FairValue members, in the specific section, by logging into the FairValue Member account.
Utilizatorul poate programa o intalnire prin completarea formularului disponibil in rubrica specifica, urmand a fi contactat de un reprezentant FairValue pentru confirmarea programarii.In cazul redirectionarii la un website tert, prezentele Termenii si Conditiile nu vor fi mai aplicabile si in cazul navigarii Utilizatorului pe acel site. Astfel, din momentul redirectionarii Utilizatorului, FAIRVALUE nu isi asuma raspunderea in nicio situatie cu privire la politicile, termenii si conditiile aplicabile pe platforma online respectiva.Prin folosirea Site-ului, Utilizatorul este singurul responsabil pentru toate activitatile care decurg din utilizarea acestuia. De asemenea, acesta raspunde pentru orice daune materiale, intelectuale, electronice sau de orice alta natura produse Site-ului si/ sau Continutului pus la dispozitie de FairValue, in conformitate cu legislatia nationala in vigoare.
If the User does not agree with these Terms and Conditions and/or does not accept this Document, he/she has the possibility to send an e-mail to the following electronic correspondence address: office@fvalue.ro si va preciza motivele si/ sau solicitarile de operare a modificarilor dorite.
The User may at any time reverse his/her decision not to agree and/or not to accept the Document.
The name of the Site and its graphic signs are the property of FairValue or, as the case may be, the Company holds a right of use over them, so these elements cannot be taken over, copied or used without the written consent of their owner/holder.
All Content presented or displayed on the Site including, but not limited to: text, graphics, photographs, images, moving images, sound and illustrations, etc. is the property of FairValue. All elements are protected by copyright, author's rights and other intellectual property rights regulations.
The FairValue Logo is a registered trademark. It may only be used with the consent of FairValue. For media and advertising purposes, the Logo may be used under the conditions set out in the PDF document entitled ,,brand identity FairValue – section2 – logo mark’, available for download from the section,,Press kit’’.
FairValue strongly urges you to carefully review the aforementioned document for the correct use of the Logo and to avoid any possible violations of the intellectual property rights held by the Company through alteration/modification/use for purposes other than media and advertising or those permitted by applicable law or by another agreement between FairValue and the User.
FairValue declares on its own responsibility that all content on the website www.myfairvalue.ro is original and that it uses resources, if applicable, (product images, video, text, specifications, etc.) with the consent of the source, without violating Law no. 8/1996 on copyright and related rights. Reporting cases of copyright infringement will be made in writing to the e-mail address office@fvalue.ro. The User may not modify any of the aforementioned materials and may not copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell information or works contained on the Site. www.myfairvalue.ro.
Except as permitted by applicable law and this document, the User is responsible for obtaining permission before using any material protected by copyright or other intellectual property rights that is made available by FairValue.
Any Content to which the User has and/or obtains access by any means is subject to the Document if the Content is not accompanied by a specific and valid user agreement concluded between FairValue and the User and without any implicit or express warranty made by FairValue with reference to that Content.
The communication of any information or data in the form of message, text, image, audio and/or video file or any other type of material, regardless of the method of publication or transmission thereof (public or individual), by any natural or legal person, other than FairValue, is carried out under the exclusive responsibility of the person to whom these materials belong, the Company being in no way responsible for the content or method of publication of these communications.
If FairValue grants the User the right to use, in the form described in a separate user agreement, a certain Content to which the User has or obtains access pursuant to this agreement, this right extends only to that Content or Content defined in the agreement, only for the duration of its or these Contents' existence on the Site or the period defined in the agreement, according to the conditions defined therein, if any, and does not represent a contractual commitment on the part of FairValue for that User or any other third party who has/obtains access to this transferred content, by any means and who could be or is prejudiced in any way as a result of this Content, during or after the expiration of the user agreement.
No Content transmitted to the User, through any means of communication (electronically, by phone, etc.) or acquired by him through accessing, visiting and/or viewing does not constitute a contractual obligation on the part of FairValue and/or the Company's employee, who mediated the transfer of Content, if any.
Any use of the Content for purposes other than those expressly permitted by the Document/provided for in a separate usage agreement, if any/by applicable legislation is prohibited.
The User is liable for any intellectual damage caused to the Site, the Content or any third party/partner/collaborator with whom FairValue has concluded contracts, in accordance with Romanian legislation in force.

FairValue publishes its complete and correct identification data on the Site, so that contacting it by the User is easy.

Accessing the Site, using the information presented within it, visiting the pages or sending e-mails or notifications addressed to the Company may be done by electronic means of communication, by telephone or any other means of communication available to the parties, thus being considered that the User consents, in turn, to receiving notifications from FairValue electronically and/or by telephone, including communications by e-mail or through announcements published on the Site.
FairValue reserves the right not to respond to all requests of any nature, especially if they are unfounded/abusive, received through any means of communication (electronic, telephone, etc.).
The user expressly declares that the contact details provided by sending them to the e-mail address office@fvalue.ro belongs to (for example: first and last name, email address, phone number, etc.) and that this data may be used by the Company in its communications with the User, for the purpose of resolving any requests, but also for providing additional information, at the User's request.
3.4. Confidentiality of personal data
FairValue makes every effort to ensure that it protects and respects the confidentiality of personal data belonging to its Users, by implementing appropriate technical and organizational measures, in accordance with the requirements of Regulation No. 679/2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC. (General Data Protection Regulation) and Law No. 190/2018 on the implementation of the General Data Protection Regulation and good practices in data processing.
The information provided by the User will be stored by FAIRVALUE in electronic format and will not be provided to any third party other than those directly involved in providing services specific to the Site. www.myfairvalue.ro .
For more details regarding the processing of personal data that the Company carries out in the context of browsing the Site or interacting with it, through postal/electronic correspondence, the data subject should consult Privacy policy displayed on the website.
3.5. Newsletters
Receiving Newsletters and other alerts of this kind requires checking the corresponding box in the form on the Site, commercial and informative communications being transmitted only based on the express consent of the Client. Thus, the User becomes a Subscriber and unconditionally accepts these Terms and Conditions, including if he has not previously expressed his agreement to receive such communications through another means.
Subscription to the Newsletter offered by FairValue can only be made if the User is 18 years of age at the time of submitting the subscription intention or has the consent of the legal representative in this regard and is not conditioned by the payment of a fee or the registration of a user account.
The personal data used by FairValue for the transmission of newsletters will be used by the Provider only for the purposes described in the Privacy Policy, and in accordance with its provisions, a document available for consultation on the Site.
The Subscriber can easily opt out of receiving the Newsletter at any time by withdrawing consent to the processing of their data for marketing purposes and by expressing their intention to unsubscribe, as follows:
a. using the specific unsubscribe option within any newsletter received;
b. by contacting the Provider via e-mail and transmitting the intention to unsubscribe from the Newsletter and without any subsequent mutual obligation of either Party or without either Party being able to claim damages from the other.
Renouncing the receipt of the Newsletter does not imply renouncing the consent expressed for this Document, this renunciation having effects only for the future, after communicating the intention to withdraw consent.
FairValue will not be bound by the obligation to send the Newsletter to the Subscriber.
The Provider will not include in its newsletters sent to the Subscriber any type of advertising material in the form of content that refers to a third party that is not a partner of FairValue.
FairValue does not request from its Users, through any means of communication (e-mail/telephone/SMS), information regarding confidential data, accounts or personal passwords.
The user assumes full responsibility for the disclosure of his confidential data to a third party.
The Provider declines any responsibility in the event that a User is/is harmed in any way by a third party claiming to be/represent the interests of the Provider. The User shall inform the Provider of such attempts, using the contact details.
FairValue does not promote SPAM.
Any User who has explicitly provided their email address on the Site may opt to delete it.
Communications made by FairValue through electronic means of distance communication (i.e. e-mail) contain the complete and compliant identification data of the sender or links to them, at the date of transmission of the Content.
The following goals achieved or not will be considered an attempt to defraud the Site/Content and/or the Provider and, in this case, criminal investigation will be initiated against the person(s) who attempted to or has achieved these goals(s):
• to access any type of data of another User by using the FairValue member account or by any other method;
• to alter or otherwise modify the content of the Site or the Content sent by any method by the Provider to the User;
• to affect the performance of the server(s) on which the Site runs;
FairValue nu raspunde pentru erorile sau omisiunile care pot interveni in redactarea sau prezentarea materialelor de pe site, care nu sunt considerate informatii esentiale conform legii.FairValue nu garanteaza Utilizatorului accesul pe Site sau la Serviciu.FairValue nu raspunde de continutul, calitatea sau natura altor site-uri la care se ajunge prin legaturi din Continut, indiferent de natura acestor legaturi. Pentru respectivele site-uri, raspunderea o poarta, in mod integral, proprietarii acestora.Prestatorul este exonerat de orice vina in cazul utilizarii Site-ului si/ sau al Continutului transmis catre Utilizator sau Client prin orice mijloc (electronic, telefonic etc.), prin intermediul Site-ului, e-mail-ului sau al unui angajat al FairValue, atunci cand aceasta utilizare a Continutului poate produce efectiv pagube de orice natura de partea Utilizatorului, Clientului si/sau oricarui tert implicat in acest transfer de Continut.
FairValue cannot be held liable in any way to any Customer who uses the Site or the Content, other than within the limits of the articles constituting the Terms and Conditions.
The Provider does not assume responsibility for potential malware that may infect your computer or other property as a result of accessing or using this Site or downloading any material, information, text, video or audio images from it.
The Provider is not responsible for covering third-party claims of any nature that may arise in relation to the use, copying or falsification of the Site or its content or any other related Site by third parties, not authorized by FairValue, regardless of whether it was informed, knew or should have known of this possibility.
FairValue does not provide any direct or indirect guarantees that:
• The Service will be tailored to the User's requirements;
• The Service will be uninterrupted, secure or free from errors of any kind;
• The services will correspond to the User's subjective requirements or expectations.
By using/visiting/viewing etc. the Site and/or any Content sent by FairValue to the User by accessing and/or sending by any means (electronically, by phone, etc.), acesta se declara de acord cel putin cu prezentele Termeni si conditii.
This Agreement is considered concluded in Romania and, consequently, is governed by the legal provisions applicable on the territory of Romania. Any dispute with reference to the Document that may arise between the User and FairValue will be resolved amicably. If the amicable resolution of the conflict is not possible within 30 days from the registration of the complaint, it will be resolved by the competent court at the headquarters of FairValue.
FairValue is not liable for any losses, costs, lawsuits, claims, expenses, etc., if they are directly caused by failure to comply with the Terms and Conditions.
If any of the above clauses is found null or invalid, regardless of the cause, this clause will not affect the validity of the other clauses of this Agreement.
FairValue reserves the right to make any changes to the provisions of this Document, as well as any changes to the Site/its structure, including changes that could affect the Site and/or any Content, without prior notification to the User in this regard.
FairValue cannot be held responsible for any errors that may occur on the Site for any reason, including due to changes, settings, etc., that are not made by the Site administrator.
FairValue reserves the right to insert advertising banners of any nature and/or links on any page of the Site, in compliance with the legislation in force.

This agreement document between the parties was drafted in accordance with the legislation applicable on the territory of Romania.
