\u00a0\u00a0\u00a0\u00a0\u00a0Even though in the last quarter of 2022 the building tax situation was uncertain, in December of the same year everything became clear, with the current building tax system remaining unchanged in 2023 and 2024, the new one being able to officially apply from 2025, according to the law published in the Official Gazette.<\/p>\n

The modification to the current system consisted in eliminating the phrase mixed-use building. For taxpayers who own buildings that include both residential and non-residential spaces, the tax is calculated by the local tax authority. In this situation, an evaluation report prepared by an authorized evaluator is no longer required.<\/p>\n

In contrast, legal entities that own residential or non-residential buildings still have the possibility to submit an evaluation report to the General Directorate of Taxes and Local Fees to avoid tax increases.<\/p>\n

Taxpayers must consider the following aspect in order to establish the tax on buildings: in the case of companies, the taxable value of buildings is the value as of December 31 of the year preceding the year for which the respective tax is due and can be represented by:<\/p>\n

o the last taxable value recorded in the records of the local tax authority;<\/p>\n

o the value resulting from a valuation report prepared by an authorized valuer in accordance with the Property Valuation Standards in force on the valuation date;<\/p>\n

o the final value of construction works, in the case of new buildings, constructed during the previous fiscal year;<\/p>\n

o the value of the buildings resulting from the deed by which the ownership right is transferred. In practice, however, there may be a number of situations in which the ownership right of a building is transferred through deeds in which the purchase price of the building is not specified, such as donation contracts, exchange contracts, etc. \u2013 in this case, the last value recorded in the local tax authority database will be used;<\/p>\n

o in the case of buildings that are financed under a financial leasing contract, the value resulting from a valuation report prepared by an authorized valuer in accordance with the property valuation standards in force on the valuation date.<\/p>\n

The calculation of the tax on buildings owned by legal entities is carried out as follows:<\/p>\n

o for residential buildings owned or held by legal entities, the building tax is calculated by applying a rate between 0.08%-0.2% on the taxable value of the building;<\/p>\n

o for non-residential buildings owned or held by legal entities, the building tax is calculated by applying a rate between 0.2%-1.3%, inclusive, on the taxable value of the building;<\/p>\n

o for non-residential buildings owned or held by legal entities, used for agricultural activities, the building tax is calculated by applying a rate of 0.4% to the taxable value of the building.<\/p>\n

But, if taxpayers, individuals\/legal entities, do not update their taxable value, the building tax rate is 5%, so you will have to pay a higher tax. Therefore, submitting the evaluation report is not only an obligation for each of us, but even a necessity.<\/p>\n

The taxable value of buildings is updated every 5 years based on a valuation report prepared by an authorized valuer in accordance with the Valuation Standards in force. For example, for buildings owned by the company on 31.12.2022 and whose last revaluation was carried out in 2018, revaluation is recommended to avoid paying the increased tax at a rate of 5% in 2023. The deadline by which the report must be submitted to the local tax authority is March 31, 2023.<\/p>\n

Even though the deadline for submitting the valuation report is limited, the over 60 appraisers from across the country, who make up the #fairvalueteam, are ready to promptly respond to any valuation request, regardless of its complexity and the location of the buildings on Romanian territory.<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"
